| These Terms of Use regulate the relationship between the Owner ( "Administration ", "we") of the Site http ("TripWitness", "Site") and the User of the Site ("you") arising from the use of the Site. |
| By accessing or using this site you agree to observe these Terms of Use. We may modify these Terms at any time. The updated Terms will be posted on the website and you will be informed about the date they come into force. If you continue to use TripWitness after this date this means that you agree with the updated Terms. |
| 1. TripWitness is a site which purpose is sharing photos from your trips. You agree to use TripWitness for this purpose only. |
| 2. You must be at least 13 years old to use TripWitness. |
| 3. You may create the account only on your own behalf. |
| 4. You may not post photos that violate the law by any means. You may not post nude or insulting photos as well as photos that violate private life of others. You may not disclose any financial information on your photos or in your data. You must possess all the copyrights for the photos you post. |
| 5. You may use TripWitness for commercial purposes only after the written consent of the Administration. |
| 6. You are responsible for any activity from your account. You must keep your login and password secret and do not disclose them to the third parties. |
| 7. We may, but not obliged to, monitor, remove or modify in any way your photos and all other setting and details of your account without the explanation of the reasons, without liability to you. |
| 8. You realize and agree that Administration does not systematically moderate the content and some photos and information posted by users may not comply with these Terms of Use. In such a case you must immediately inform the Administration about the Terms of Use violation. You agree that the Administration is not responsible or liable for any actions of the Site users and third parties. |
| 9. You agree to participate in TripWitness rankings and with potential additional visibility of your photos associated with the participation in TripWitness rankings. This is to avoid any misunderstandings if your ideas are similar to those we have developed or are developing independently. If you anyway decide to send us any ideas, data, suggestions or any other information this means that you agree that we are free from any liability (including financial liability) if we use these materials for any purpose. |
| 10. We do not discuss the selection of the sights with the users. Please, do not send us any suggestions, either related to TripWitness or not. |
| 11. TripWitness may display advertisements and you hereby agree that the advertisements may appear on TripWitness marked as such or not. You realize that the advertisements are provided by the third parties and we are not responsible or liable for the advertisements content and your interaction with the advertiser or the advertisements provider. |
| 12. You agree that all posted photos are available to the general public. In particular, you agree that if you decide to remove the photo from your account, this does not mean that the photo (partly or in full) will not be available elsewhere. |
| 13. You may delete your photos or your TripWitness account. Afterwards you will not be able to access your photos and data. However, you agree that the deletion of your photos and/or your TripWitness account does not mean that your photos and data are not stored at the TripWitness servers and that they are not used in the same ways as photos and data from non-deleted accounts. |
| 14. You agree that TripWitness uses cookies. We use cookies for your convenience. |
| 15.You may give us permission to access your information in FaceBook services. |
| 16.Your email address will remain private. |
| 17. You agree that we may use any of your photos for promotional or advertising consideration of the TripWitness. |
| 18. You realize and assume all the risks related to the transferring photos and data to the Internet, as well as storing them on the server (these risks include, but not limited to, hacker attacks, technical faults, etc.). We will not be responsible or liable for suspension or termination of all or some TripWitness services. We will not be responsible or liable for any loss, damage or alteration of your photos and data resulting from any cause. |
| 19. We are not responsible for any loss, damage, injury, etc. directly or indirectly related to accessing, using or unavailability of TripWitness services and content. |
